1. What Fatoura Is

Fatoura is a cloud-based invoicing, billing, and accounting tool for Kuwait and GCC businesses, operated by Crowd Agency. It helps you create documents, track payments, record expenses, and generate financial reports.

2. Your Account

You must be at least 18 years old and have the legal capacity to enter into these terms. You are responsible for keeping your account credentials secure and for all activity under your account.

Each workspace is tied to one primary owner account. The owner may invite team members according to their plan limits.

3. Plans, Pricing, and Billing

Fatoura offers the following plans. Limits are per workspace per month unless otherwise stated.

A Starter plan at KD 5/month is available in-app for users who need it; it is not shown on the public pricing page.

Billing: Paid plans are billed monthly. Your plan renews automatically on the same day each month. You may cancel at any time; the plan remains active and your workspace retains its features until the end of the current billing period. No partial refunds are issued for unused days.

Refunds: Refund requests for billing errors (e.g. duplicate charges, charges after confirmed cancellation) must be submitted within 7 days of the charge to info@wecreatecrowd.com.

Downgrade: If you downgrade to a lower plan, your existing data is preserved but features above your new plan limit will become inaccessible (not deleted) until you upgrade again or remove the excess data.

4. Payments Processed by Hesabe

Online payment collection via KNET on Fatoura invoices is handled by Hesabe, a licensed payment gateway. When your client pays via a Fatoura payment link:

• Hesabe processes the card or KNET transaction directly on their own infrastructure.
• Fatoura does not store, transmit, or have access to card numbers, KNET PINs, or any payment instrument data.
• Fatoura records the payment result (amount, date, method) for your accounting records.
• Hesabe's own terms of service and any applicable Central Bank of Kuwait regulations govern the payment processing relationship.

5. Acceptable Use

You may use Fatoura only for lawful business purposes. You must not:

• Use the service to invoice for illegal goods or services.
• Send unsolicited bulk messages via the WhatsApp or email integrations.
• Attempt to access another user's workspace or data without authorisation.
• Misrepresent yourself or your business in documents created through the service.
• Reverse-engineer, copy, or attempt to extract source code or trade secrets from the service.

We reserve the right to suspend or terminate accounts that violate these terms or are used in a manner that risks harm to other users or to the service.

6. Your Data

You own the data you create in Fatoura — your clients, your invoices, your financial records. We do not sell your data. We process it only to provide and improve the service as described in our Privacy Policy.

You may export your data at any time. On account deletion, your data is removed from active systems; see the Privacy Policy for backup retention details.

7. Service Availability and Liability

Fatoura is provided "as is" without warranties of any kind, express or implied.

• No uptime guarantee. We aim for high availability but do not commit to a specific uptime percentage or service level agreement.
• No data-loss guarantee. We take backups via Firebase infrastructure, but we do not guarantee that data will never be lost. Keep your own records for critical financial data.
• Liability cap. To the maximum extent permitted by applicable law, our total liability to you for any claim arising from or related to these terms or the service is limited to the amount you paid for the service in the three months preceding the event giving rise to the claim.
• We are not liable for indirect, consequential, or punitive damages.

8. Governing Law

These terms are governed by the laws of the State of Kuwait. Any disputes arising from or relating to these terms or the service shall be subject to the jurisdiction of the courts of Kuwait.

9. Changes to These Terms

We may update these terms when the service changes materially. We will update the date at the top of this page. Continued use of the service after an update constitutes acceptance of the revised terms.
